Underage drinking — On a first offense, a citation for underage consumption of alcohol carries a three-month driver’s license suspension, whether or not the person was in a car at the time. On a second offense, the suspension is one year.
Underage DUI — Drivers under the age of 21 can be charged with driving under the influence at a BAC of .02% or greater (any alcohol in the blood). Enhanced penalties apply at BAC levels of .08%, .10%, and .16%.
Furnishing Alcohol to a Minor — This is a crime subject to incarceration and often applies to college students who are over the age of 21 and provide liquor to their underage friends; or, parents who provide alcohol for an at-home party. Additional criminal charges and civil liability are possible if the underage drinker injured someone while driving.
